dc.descriptionIn a market economy, compliance with contracts and the fulfillment of an obligation are a prerequisite for business development. The Lithuanian law system has provided various acts to protect the interests of the creditor, which would ensure, that the debtor fulfills its obligations. One of those acts is a mortgage. This legal phenomenon has received a lot of attention, but much of the literature examines the norms governing the legal relationship of a material mortgage, however the process of mortgage registration and recovery has not been studied properly and comprehensively.en_US
dc.description.abstractRinkos ekonomikoje sutarčių drausmė tarp šalių ir tikslus jų pareigų atlikimas yra būtina verslo plėtros sąlyga. Lietuvos teisinė sistema yra numačiusi įvairius būdus, skirtus apsaugoti kreditoriaus interesus, kurie užtikrintų, jog skolininkas įvykdytų savo įsipareigojimus. Vienas iš tų būdų yra hipoteka. Šis pareigų vykdymo teisinis institutas yra sulaukęs nemažai mokslininkų dėmesio, tačiau didžioji dalis teisinės literatūros nagrinėja normas, reglamentuojančias materialiosios hipotekos teisinius santykius, o hipotekos registravimo ir išieškojimo procesas nėra išsamiai ištirtas.en_US
