| dc.description | The aim of the professional BA thesis. To analyze taking of property for public needs, to identify the related problems, and to discuss their solutions. The right of ownership is the right of a landowner to manage, use, and dispose of the land he or she owns. The needs of society are a legitimate basis for restricting property rights. Research methods. Descriptive, logical – analytical, and comparative methods have been applied in this research. The structure of the professional BA thesis. The work consists of three parts. The first part of examines a person’s right of ownership and the basis for its restriction and discusses the legal acts regulating land acquisition for public needs. The second part of the work focuses on the analysis of problematic aspects. It discusses the requirements for taking land for public needs, the valuation of plots and the procedure for indemnification. Furthermore, land acquisition for the needs of special state importance is analyzed. | en_US |
| dc.description.abstract | Baigiamajame darbe nagrinėjama tema – žemės paėmimo visuomenės poreikiams teoriniai ir praktiniai probleminiai aspektai. Šio darbo tikslas – išanalizuoti nuosavybės paėmimą visuomenės poreikiams, bei identifikuoti su tuo susijusias problemas, aptarti jų sprendimo būdus. Nuosavybės teisė – tai žemės savininko teisė valdyti jam priklausančią žemę, ja naudotis ir disponuoti. Visuomenės poreikiai yra teisėtas pagrindas riboti nuosavybės teises. Darbo metodai: aprašomasis, loginis – analitinis ir lyginamasis metodai. Darbo struktūra. Darbą sudaro trys dalys. Pirmojoje darbo dalyje nagrinėjama asmens teisė į nuosavybę ir jos ribojimo pagrindai, aptariami teisės aktai, reglamentuojantys žemės paėmimą visuomenės poreikiams. Antroje darbo dalyje didelis dėmesys skiriamas probleminių aspektų analizei. Aptariami žemės paėmimo visuomenės poreikiams reikalavimai, sklypų vertinimas ir nuostolių atlyginimo tvarka. Nagrinėjamas žemės paėmimas ypatingos valstybinės svarbos poreikiams. Trečioje darbo dalyje remiantis Lietuvos teismų praktika išnagrinėti ginčų susijusių su žemės paėmimu visuomenės poreikiams sprendimo ypatumai. | en_US |
