Šiame darbe analizuojama sėkmės mokesčio dydžio nustatymo problematika, kuri siejasi su advokato profesinės etikos pažeidimais. Darbe taip pat analizuojamas sėkmės mokesčio reglamentavimas, remiantis LR Advokatūros įstatymo nuostatomis ir nustatomos spragos, kylančios dėl netinkamo sėkmės mokesčio reglamentavimo.

This work talking about the concept of success fee in civil matters and legal regulation in Lithuania, it also analyzes the relationship between lawyers and clients, based on the principles of lawyers' activities. This topic is especially relevant, as there are many conflicts between clients and lawyers arising from an agreement on the success fee. Success fee topic in Lithuania is a relatively new issue, because there is no law regulating and clearly defining the order and size of the payment of success fee, and there are many problems in determining the reasonable amount of salary success. In pursuing their professional activities lawyers must comply not only with statutory requirements, but also with ethical and moral responsibility, and therefore an agreement on the salary of success is to be considered to be in conflict with the lawyer's activity principles. Objectives of the - analyze and evaluate the advantages and disadvantages of the success fee, and also, according to the jurisprudence, to assess the problems arising from the regulation of success fee. Methods - in this work, the following methods were used: analytical, research and comparative. The structure – Lithuanian Bar Association and its legal regulation - this part analyzes the principles of the lawyer's activities, the issue of the impeccable reputation of an advocate, the principle of the pactum de quotas litis. Success Fee Legal Regulation - this section analyzes the regulation of success fee in Lithuania and abroad, the advantages and disadvantages of a success fee. Court decisions – this section analyzes the practice of foreign and Lithuanian courts is analyzed and legal rules are developed. The results/conclusions - having analyzed this problem, one can conclude that the success fee does not provide effective legal aid, but, on the contrary, customers overpay for the services of a solicitor; therefore, in order to resolve these problems, it would be appropriate to issue substatutory legal acts that would regulate the determination of the amount of the success fee and the procedure for the payment of the success fee. The work consists of 41 pages, 34 references and sources of information.
