Description:
Problematic aspects of identification and qualification of violence in the close environment. Sigita Pociuvienė. Professional Bachelor thesis. Supervisor Genovaitė Ročienė. University of Applied Sciences, Faculty of Management and Economics, Department of Law. The Bachelor‘s paper analyses the violence in the near environment which is quite a sensitive subject. In Lithuania it is a current issue because we can often hear both on television and on the Internet about the criminal acts of violence. The material of BA thesis reflects the problems faced in the Lithuanian judicial authorities when deciding disputes precisely because of the violence in the immediate environment. The main problem – to identify how accurately law courts should sort out, when its just a bad behavior, bad raising, or when the line is crossed and this behavior can be considered violence, which brings criminal responsibility and can be considered as violence in a close environment The methods used in this BA thesis – legislation analysis and statistical analysis of the research. The structure - 1. The concept of violence and close environment, where these two concepts are explained; 2. Identification of the problematic aspects of violence, where on the basis of the case law analysis, when the zero-tolerance behavior is recognised as physical, mental, or any kind of violence against children. 3. The problem of violence qualification, which analyzes when an act is classified as violence in close relationships. The conclusions – life without marriage is in line with the concept of the family if it is based on emotional attachment, mutual understanding, responsibility, respect or raising of a child to assume certain rights and obligations. In law court‘s practice it is essential for the victim to experience pain and this feeling must be expressed in such a way as to be perceived by others. Although it is not necessary for a threatening-person to do a threat, it is necessary to make sure that the victim has an objective basis to fear of his own life. Existing relationships in the close environment must be based on mutual resposibility, mutual commitment, strong emotional interactions and emotional attchment. In this case, law court can qualify as a violence in close relationships.
