Viena iš svarbiausių baudžiamojo procesų stadijų yra ikiteisminis tyrimas ir jo pradžia. Būtent nusikalstamos veikos tyrimo sėkmę lemia iki galo atlikti rezultatyvūs tyrimo veiksmai. Ikiteisminis tyrimas vyksta visais atvejais, bet yra keletas išimčių, kad ikiteisminis tyrimas būtų pradėtas, reikalinga nukentėjusiojo valios išreiškimas, dėl procesinių veiksmų. Būtent įstatymų leidėjai, atsižvelgdami į asmenų teises ir užtikrindami nukentėjusiojo interesus, sukuria alternatyviausias išeitis, ikiteisminiam tyrimui pradėti. Atskira ikiteisminio tyrimo pradėjimo stadija yra ikiteisminio tyrimo pradžia tik pagal nukentėjusiojo skundą ar jo teisėto atstovo pareiškimą, ar prokuroro reikalavimą institutas.

Topicality of the topic: It is marked by the fact that after the decision to initiate a pre-trial investigation also begins a criminal proceeding initiated not by the state but by the injured person from whom the pre-trial investigation begins with the will and initiative. An initiative to initiate a pre-trial investigation may be adopted only on relevant grounds, the assessment of which will be analyzed at work. Currently, it is also relevant that the possibility of carrying out certain actions is foreseen in the CPC of the Republic of Lithuania and the pre-trial investigation may not be initiated. What is also relevant is the fact that more and more criminal offenses are committed against people who are powerless, whose rights are restricted, due to their condition, and the inability to defend themselves. Problematics: In certain cases, a person's right to defend subjective rights in a criminal proceeding may be restricted if the initiative to express the will regarding the initiation of a pre-trial investigation may be affected by the condition or condition of the victim. Such cases are attributable to the injured person being in a state of impotence. Moreover, the prosecutor's discretion to initiate a pre-trial investigation is also not explicitly regulated by criminal procedure laws. In other words, there are no clear criteria for establishing a pre-trial investigation in accordance with the prosecutor's request. The aim of this thesis is to evaluate and analyze conditions and the institute of the commencement of pre-trial investigation based on victim’s accusations or prosecutor’s demand, as well as to solve theoretical and practical problems of it. Methods of the study – scientific, systematic, comparative, empirical, logical. Structure of the work: This work consists of: summary in Lithuanian and English, introduction, three chapters, conclusions, list of used literature. Thesis consist of 41 pages. Results of the work: After analyzing the chosen topic, it can be assumed that the initiation of pre-trial investigation in exceptional cases depends on the will and desire of the victim. The possibility of performing certain actions is foreseen in the CPC of the Republic of Lithuania and the pre-trial investigation may not be initiated.
