| dc.description | The aim of the professional BA thesis. To analyze the structure and features of criminal offense of embezzlement, to disclose problematic aspects of its qualification. Research methods. Analysis of scientific literature, legislation, and case law has been applied in the research. The structure of the professional BA thesis. The thesis consists of introduction, 3 chapters, conclusions, and a list of references. In the first part of the work the historic development of regulation of criminal offense of embezzlement is discussed. In the second part the structure of criminal offense of embezzlement in accordance with LR BK and the laws of other countries are analyzed. In the third part of the work the analysis of case law discloses the problems that occur while qualifying and proving the criminal offense of embezzlement in case law. | en_US |
| dc.description.abstract | Darbo tikslas – išanalizuoti nusikalstamos veikos turto pasisavinimo sudėtį, jos požymius, atskleisti kvalifikavimo probleminius aspektus. Darbo metodai – mokslinės literatūros analizė, teisės aktų analizė, teismų praktikos analizė. Darbo struktūra – baigiamąjį darbą sudaro įvadas, 3 skyriai, išvados ir literatūros šaltinių sąrašas. Pirmojoje darbo dalyje aptariama turto pasisavinimo nusikalstamos veikos teisinio reglamentavimo istorinė raida. Antrojoje darbo dalyje analizuojama turto pasisavinimo nusikalstamos veikos sudėtis pagal LR BK bei kitų valstybių įstatymus. Trečiojoje darbo dalyje analizuojant teismų praktiką, atskleidžiamos problemos, kurios kyla kvalifikuojant ir įrodinėjant turto pasisavinimo nusikalstamą veiką teismų praktikoje. | en_US |
