The purpose of this work is to draw attention to the new type of transactions - these are online transactions. Online transactions become so common in the everyday and business world that they are sometimes not even noticeable as they are made. Traditionally, the laws are slightly behind compared to technological changes, thus creating uncertainty, the stage of experimentation, as well as disagreements and uncertainties. This work focuses on the online transaction mechanism, both nationally and internationally, focusing on problematic aspects. The problematic aspects of the validity of online transactions, problems arising from online transactions are analyzed. Based on traditional trading and commercial law and considering the technological features of the web, the problematic aspects of online transactions are analyzed. This work consists of sections: The concept of online transactions, which overviews the concepts of an online contract and electronic document; The making an online contract, with a wider discussion of the offer, an invitation to treat, an acceptance, and the problematic aspects of the contract making; The validity of the online document, which explores the rules applicable to electronic documents and the legal validity of the electronic signature; Problems arising from online transactions, analyzing such problematic aspects as the protection of personal data, applicable law and jurisdiction. The key findings of the work are that the legal regulation of the contracting process is dualistic today, so the question is whether the choice of such a regulatory model makes it possible to provide legal clarity to online e-commerce participants. It also concludes that moving traditional categories of contract law into virtual space is not as problematic as it may seem at first glance. It is emphasized that, although the law establishes certain requirements for the award of contracts online, it does not clearly state what their legal significance is. Finally, it can be seen that, in theory, the validity and probative value of online contracts are not an obstacle, but the case-law is contradictory.
