Having introduced the possibility of questioning a person as a witness about his alleged criminal offense in a criminal proceeding, a certain debate arose in the legal theory of Lithuania, as a participant in a new kind of process emerging, possibly interfering with the traditional procedural statuses - the suspect and the witness. The practical implications of applying this institute are also not clear, since the Institute is essentially regulated by a substatutory legal act. For this reason, the practical application of the Special Witness Institute in a criminal proceeding acquires a certain degree of uncertainty which may lead to the abuse of this institute by pre-trial investigation officials or prosecutors. The aim of the paper is to analyse the legal regulation of the status of a special witness in a criminal procedure, and comparative, legal and practical aspects of legal issues. Objectives to achieve the goal: 1. To analyse the origins of the special witness status and the legal basis. 2. To analyse the legal status of the special witness status, to review the peculiarities of application.3. To establish the shortcomings and problems of legal regulation of the special witness status in criminal proceedings.4. To examine the application of the status of a special witness in the practice of the courts of Lithuania. The object of the research is the legal problems of the status of a special witness. The structure of the work - the work consists of three main parts. The first part of the final thesis analyses the status of a special witness and its origins. The second part of the work deals with the peculiarities of legal regulation of a special witness. The third part deals with the application of a special witness in court practice, the issue of a special witness in a criminal proceeding. The main conclusions - after analysing the national legislation of the Republic of Lithuania, it can be argued that a special witness, having an interest in the case, can give false testimonies and mislead the whole process. The special witness, unlike the witness, becomes dependent on the will of the person, i.e. y a person can agree or not to be questioned as a witness about his allegedly committed criminal offense. en
dc.description.abstract Įvedus galimybę apklausti asmenį kaip liudytoją apie savo galimai padarytą nusikalstamą veiką į baudžiamąjį procesą, Lietuvos teisės teorijoje kilo tam tikrų diskusijų, kadangi atsirado naujos rūšies proceso dalyvis, galimai įsiterpęs tarp tradicinių procesinių statusų – įtariamojo ir liudytojo. Praktinė šio instituto taikymo reikšmė taip pat nėra aiški, nes institutas iš esmės yra reglamentuojamas poįstatyminiu teisės aktu. Dėl šios priežasties specialiojo liudytojo instituto praktinis pritaikymas baudžiamojo proceso metu įgauna tam tikro neaiškumo, kuris gali lemti ikiteisminio tyrimo pareigūnų ar prokuroro piktnaudžiavimą šiuo institutu. en_US
